পরিচ্ছেদঃ ২৮১ : তিনজনের একজনকে ছেড়ে দু’জনের কানাকানি
কোন স্থানে একত্রে তিনজন থাকলে, একজনকে ছেড়ে তার অনুমতি না নিয়ে দু’জনে কানাকানি করা [বা প্রথম ব্যক্তিকে গোপন করে কোন কথা বলাবলি করা] নিষেধ। তবে প্রয়োজনবশতঃ এমন গোপন-ভাবে কোন গুপ্ত কথা বলা যে, যাতে তৃতীয়-জন যেন তা না শুনতে পায়, তাহলে তা বৈধ। অনুরূপ দু’জনের এমন ভাষায় কথা বলা যা তৃতীয় ব্যক্তি বুঝে না, তাও নিষিদ্ধের পর্যায়ভুক্ত।
আল্লাহ বলেছেন,
﴿إِنَّمَا النَّجْوَىٰ مِنَ الشَّيْطَانِ﴾ [المجادلة: ١٠]
অর্থাৎ গোপন পরামর্শ তো শয়তানেরই প্ররোচনা। (সূরা মুজাদিলাহ ১০ আয়াত)
১/১৬০৬। ইবনে উমার রাদিয়াল্লাহু আনহু হতে বর্ণিত, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেন, ’’যখন [কোন স্থানে] একত্রে তিনজন থাকবে, তৃতীয়-জনকে ছেড়ে যেন দু’জনে কানাকানি না করে।’’ (বুখারী ও মুসলিম) [1]
উক্ত হাদিসটি ইমাম আবূ দাঊদ [স্বীয় গ্রন্থে] বর্ধিত আকারে বর্ণনা করেছেন, আবূ সালেহ বলেন, আমি ইবনে উমারকে জিজ্ঞাসা করলাম, ’যদি [একত্রে] চারজন হয় [তাহলে দু’জনে কানাকানি করা বৈধ কি না]?’ তিনি উত্তর দিলেন, ’তাতে তোমার কোন ক্ষতি হবে না।’
ইমাম মালেক উক্ত হাদিসকে তাঁর ’মুঅত্তা’ গ্রন্থে আব্দুল্লাহ ইবনে দ্বীনার থেকে উদ্ধৃত করেছেন। আব্দুল্লাহ ইবনে দ্বীনার বলেন, আমি ও ইবনে উমার খালেদ ইবনে উক্ববার বাজারের বাড়ির নিকট অবস্থান করছিলাম। ইত্যবসরে একটি লোক এসে পৌঁছল, যার ইচ্ছা ছিল ইবনে উমারের সাথে কানে কানে কিছু বলবে। আর ইবনে উমারের সাথে আমি ছাড়া আর কেউ ছিল না।
সুতরাং ইবনে উমার তৃতীয় একজন লোককে ডাকলেন। পরিশেষে আমরা মোট চারজন হয়ে গেলে তিনি আমাকে ও আহূত তৃতীয় ব্যক্তিকে সম্বোধন করে বললেন, ’তোমরা একটু সরে দাঁড়াও। কেননা, আমি আল্লাহর রাসূল সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম-কে একথা বলতে শুনেছি যে, ’’[একত্রে তিনজন থাকলে] একজনকে ছেড়ে যেন দু’জনে কানাকানি না করে।’’
(281) بَابُ النَّهْيِ عَنْ تَنَاجِيْ اِثْنَيْنِ دُوْنَ الثَّالِثِ بِغَيْرِ إِذْنِهِ إِلَّا لِحَاجَةٍ وَهُوَ أَنْ يَّتَحَدَّثَا سِرًّا بِحَيْثُ لَا يَسْمَعُهُمَا، وَفِيْ مَعْنَاهُ مَا إِذَا تَحَدَّثَ اِثْنَانِ بِلِسَانٍ لَا يَفْهَمُهُ
وَعَنِ ابنِ عُمَرَ رَضِيَ اللهُ عَنهُمَا : أَنَّ رَسُولَ اللهِ صلى الله عليه وسلم صلى الله عليه وسلم قَالَ: «إِذَا كانُوا ثَلاثَةً، فَلاَ يَتَنَاجَى اثْنَانِ دُونَ الثَّالِثِ» . متفق عَلَيْهِ .
وَرَوَاهُ أَبُو دَاوُدَ وَزَادَ : قَالَ أَبُو صَالِح : قُلْتُ لابنِ عُمرَ : فَأَرْبَعَةً ؟ قَالَ: لاَ يَضُرُّكَ.
وَرَوَاهُ مَالِكٌ فِي "الموَطأ": عَن عَبدِ اللهِ بنِ دِينَارٍ، قَالَ: كُنْتُ أَنَا وابْنُ عُمَرَ عِنْدَ دَارِ خَالِدِ بنُ عُقْبَةَ الَّتي فِي السُّوقِ، فَجَاءَ رَجُلٌ يُريدُ أَنْ يُنَاجِيَهُ، وَلَيْسَ مَعَ ابْنِ عُمَرَ أَحَدٌ غَيْرِي، فَدَعَا ابْنُ عُمَرَ رَجُلاً آخَرَ حَتَّى كُنَّا أَرْبَعَةً، فَقَالَ لِي وَلِلرَّجُلِ الثَّالِثِ الَّذِي دَعَا : اسْتَأْخِرَا شَيْئاً، فَإنِّي سَمِعْتُ رَسُولَ اللهِ صلى الله عليه وسلم صلى الله عليه وسلم يقُولُ : «لاَ يَتَنَاجَى اثْنَانِ دُونَ وَاحِدٍ» .
(281) Chapter: Prohibition of two Holding Secret Counsel to the Exclusion of Conversing together a Third
Allah, the Exalted, says:
"Secret counsels (conspiracies) are only from Shaitan (Satan).'' (58:10)
Ibn 'Umar (May Allah be pleased with them) said:
the Messenger of Allah (ﷺ) said, "In the presence of three people, two should not hold secret counsel, to the exclusion of the third."
[Al- Bukhari and Muslim].
In Abu Dawud, Abu Salih related: I asked Ibn 'Umar: "What if there are four people." He said, "There is no harm in that."
Malik reported in Al-Muwatta that 'Abdullah bin Dinar related: Ibn 'Umar and I were together in Khalid bin 'Uqbah's house which was situated in the market place. A man came to consult Ibn 'Umar. None besides me was present. Ibn 'Umar called another man in and we became four and said to me and the man he had called: Move away a bit because I have heard the Messenger of Allah (ﷺ) saying, "The two people should not hold secret counsel together excluding the third."
Commentary: This Hadith teaches us certain etiquettes of society. Ibn `Umar (May Allah be pleased with them) called the fourth person so that he (Ibn `Umar) could hear the conversation of the man who wanted to speak to him in isolation. He asked the other two to move to a distance so that they could not overhear what the person in question wanted to say to him. Thus, we learn that in the presence of more than one person, two can speak to each other in confidence. If there are four people, three of them are not permitted to speak in confidence leaving the fourth alone. Moreover, this prohibition is for lawful matters only because in unlawful matters such private conversation is
altogether forbidden, even if there is no third person. The Noble Qur'an ordains:
"O you who believe! When you hold secret counsel, do it not for sin and wrong and disobedience to the Messenger, but do it for righteousness and self-restraint; and fear Allah, to Whom you shall be brought back.'' (V.58:9)

২/১৬০৭। ইবনে মাসঊদ রাদিয়াল্লাহু আনহু হতে বর্ণিত, রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম বলেছেন, ’’যখন [একত্রে] তিনজন থাকবে, তখন লোকদের সঙ্গে মিলিত না হওয়া অবধি একজনকে ছেড়ে দু’জনে যেন কানাকানি না করে। কারণ, এতে [ত্যক্ত ব্যক্তিকে] মনঃকষ্টে ফেলা হবে।’’ (বুখারী ও মুসলিম) [1]

(281) Chapter: Prohibition of two Holding Secret Counsel to the Exclusion of Conversing together a Third
Ibn Mas'ud (May Allah be pleased with him) said:
The Messenger of Allah (ﷺ) said, "When three of you are together, two of you must not converse privately ignoring the third till the number increases, lest the third should be grieved."
[Al-Bukhari and Muslim].
Commentary: This Hadith tells us that holding private counsel has been prohibited for the reason that it hurts the feelings of the Muslim who is ignored; and to hurt the feelings of a Muslim is a great sin indeed. Allah says:
"And those who annoy believing men and women undeservedly, bear on themselves the crime of slander and plain sin.''(33:58)
Whispering of the two is permissible when all the three mix up in a crowd. Then the two can speak to each other in confidence.
